{"id":3177,"date":"2025-01-28T16:19:39","date_gmt":"2025-01-28T15:19:39","guid":{"rendered":"https:\/\/javiergomiz.com\/?p=3177"},"modified":"2025-09-23T07:35:05","modified_gmt":"2025-09-23T05:35:05","slug":"unlicensed-drones","status":"publish","type":"post","link":"https:\/\/javiergomiz.com\/en\/unlicensed-drones\/","title":{"rendered":"Unlicensed drones"},"content":{"rendered":"\n<p>Flying a <strong>drone without a licence<\/strong>, as of today and with current regulations in hand, <strong>it&#8217;s possible<\/strong>, but <a href=\"https:\/\/javiergomiz.com\/en\/drone-operator-registration\/\">registering as a drone operator<\/a>, which is something different from a licence, may be something you have to do.<\/p>\n\n<p>With the implementation of Commission Implementing Regulation (EU) 2019\/947, all UAS operators, including model aircraft operators, will be required to register as operators if they plan to conduct operations with any type of UAS, including the following:<\/p>\n\n<p>In the \u2018open\u2019 category, the use of unmanned aircraft meeting one of <strong>these conditions<\/strong> is permitted:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Have a maximum take-off weight (MTOM) of 250 g or more, or which can transfer more than 80 joules of kinetic energy to a person in the event of a collision.<\/li>\n\n\n\n<li>Are equipped with a sensor capable of capturing personal data, unless they comply with Directive 2009\/48\/EC, known as the \u2018Toys Directive\u2019.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>In the \u2018specific\u2019 category, any unmanned aircraft, regardless of weight, is permitted to operate.<\/p>\n\n<p>These are the <strong>2 fundamental requirements<\/strong> you have to meet to fly a <strong>drone without a license<\/strong>. From this point on, you should consider another series of rules depending on the location where you want to carry out your activity.<\/p>\n\n<div><iframe width=\"800\" height=\"500\" src=\"https:\/\/www.youtube.com\/embed\/aOwTUgqUfH8?modestbranding=1&#038;rel=0;loop=1;controls=0\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe><\/div>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>It is important to know that the AESA drone operator registration and the <a href=\"https:\/\/www.seguridadaerea.gob.es\/es\/ambitos\/drones\/formacion-de-pilotos-a-distancia-de-uas-drones\/formacion-de-pilotos-uas-drones-en-categoria-rabiertar\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">license or theoretical training<\/a> and <strong>practical<\/strong> training are different things.<\/p>\n<\/blockquote>\n\n<p>These <a href=\"https:\/\/javiergomiz.com\/en\/type-of-drones\/\">types of drones<\/a> <strong>are<\/strong> <a href=\"https:\/\/javiergomiz.com\/en\/type-of-drones\/#clase0\">class 0 drones<\/a> and, in order to fly them, all that is required of the pilot is that he\/she is at least <strong>familiar with the user manual provided by the UAS manufacturer<\/strong>.<\/p>\n\n<p><s>A <strong>very interesting advantage<\/strong> of unlicensed drones over drones weighing more than 250 grams is that, taking into account other possible restrictions, they <strong>can fly within towns and cities<\/strong> without the need for prior notification or permission to fly as long as <strong> they do not exceed a height of 20 m<\/strong><\/s>. (<em>Update below<\/em>).<\/p>\n\n<p>Update of the <a href=\"https:\/\/sede.mir.gob.es\/opencms\/export\/sites\/default\/es\/procedimientos-y-servicios\/comunicacion-de-vuelo-de-aeronave\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">New Royal Decree 517\/2024<\/a>: As of June 25 and once it has become official published in the BOE on June 4, 2024 with the new regulatory changes, as the European regulation no longer makes a distinction between professional and recreational flights, <strong>all drones flying in areas with buildings<\/strong>, less and more than 250gr (urban areas or in agglomeration of buildings, formerly) must make a <a href=\"https:\/\/sede.mir.gob.es\/opencms\/export\/sites\/default\/es\/procedimientos-y-servicios\/comunicacion-de-vuelo-de-aeronave\/\">communication to the Ministry of Interior<\/a> their activity 5 days before performing it.<\/p>\n\n<p><s>Although this may change <strong>as of 2024<\/strong> and at least these unlicensed drones will have to at least <strong>notify the Ministry<\/strong> (I repeat, notification, so you should not expect a reply), as drones over 250 grams already do. You have no excuse not to fly a drone!<\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n<p >No se han encontrado productos.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-que-dron-necesita-permisos-y-licencia-en-espana\"><span class=\"ez-toc-section\" id=\"Which_drones_are_needed_a_license_to_be_flown\"><\/span>Which drones are needed a license to be flown<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>As mentioned above, <strong>drones that need permits and licences in Spain<\/strong> are any drones that meet one of the following requirements:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Those <strong>drones weighing more than 25 kg<\/strong> (55 lbs)<\/li>\n\n\n\n<li>If you are going to perform an activity or make a professional use of them.<\/li>\n\n\n\n<li>Drones belonging to <strong>class C1 marking<\/strong>.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-que-hacer-con-un-dron-de-menos-de-250-gramos\"><span class=\"ez-toc-section\" id=\"What_to_do_with_a_drone_weighing_less_than_250_grams\"><\/span>What to do with a drone weighing less than 250 grams <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>Here&#8217;s <strong>what to do with an unlicensed drone under 250 grams and its main considerations and rules<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>It is possible<strong> to fly in population centers and\/or gatherings of people<\/strong> always <strong>without exceeding 20 meters<\/strong> in height, but with the obligation to <a href=\"https:\/\/sede.mir.gob.es\/opencms\/export\/sites\/default\/es\/procedimientos-y-servicios\/comunicacion-de-vuelo-de-aeronave\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">notify the Ministry of the Interior<\/a> of the activity to be carried out 5 days prior to the flight.<\/li>\n\n\n\n<li>If your drone has a camera, you can <strong>record photographs and videos<\/strong> but you <strong>must comply with data protection regulations, the right to honor, privacy, self-image and possible restrictions on photographic flight<\/strong> that may exist in the area where you decide to make the flight with the drone. <\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>Even if you have an <strong>unlicensed drone of less than 250 grams<\/strong>, you must take into account some considerations before the flight, and you must also know that for <strong>some areas and types of operations<\/strong> you will have some <strong>restrictions<\/strong> that you must respect:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The most important thing is <strong>NOT to fly the drone in controlled spaces<\/strong>.<\/li>\n\n\n\n<li>Keep the <strong>drone ALWAYS in sight<\/strong>.<\/li>\n\n\n\n<li>You must <strong>fly in daylight<\/strong> and suitable weather conditions. You must not fly in <strong>fog, rain or strong wind<\/strong>.<\/li>\n\n\n\n<li><strong>You cannot fly in National Parks<\/strong>, <strong>wildlife conservation<\/strong> areas, <strong>Biosphere Reserves<\/strong> and Protected Natural Areas (<strong>PNA<\/strong>) without an <strong>approved permit<\/strong> from the competent body. If you come to Mallorca and want to fly your drone I tell you how<a href=\"https:\/\/javiergomiz.com\/en\/fly-drones-mallorca\/\"> to contact the environmental agencies of the island<\/a>.<\/li>\n\n\n\n<li><s>You must carry a <strong>fireproof identification plate<\/strong> on both the drone and the radio-controlled controller, <strong>mandatory for all drones since 2021<\/strong><\/s>. You no longer need it.<\/li>\n\n\n\n<li><s><strong>Third party insurance<\/strong><strong> is not compulsory<\/strong>, but it is advisable.<\/s> Third party liability insurance is no longer mandatory either for all drones or for flying in all categories. Check the changes on <strong>drone insurance<\/strong> in my <a href=\"https:\/\/javiergomiz.com\/en\/new-uas-royal-decree\/\">article on the new Royal Decree UAS<\/a>. <\/li>\n<\/ul>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-multa-por-volar-un-dron-sin-licencia\"><span class=\"ez-toc-section\" id=\"Fine_for_flying_unlicensed_drones\"><\/span>Fine for flying unlicensed drones<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>There are two scenarios in which you may be proposed for a fine if you fly an <strong>unlicensed drones<\/strong> :<\/p>\n\n<p>If you fly <strong>unlicensed drones<\/strong> and you do so under circumstances that do not endanger yourself or others, such as <strong>reckless flying, being under the influence of alcohol or drug<\/strong>s, absolutely nothing would happen.<\/p>\n\n<p>But if you <strong>fly unlicensed drones<\/strong> <strong>and you don&#8217;t have one<\/strong>, you can get into <strong>big trouble<\/strong> and face <strong>fines that can be very large<\/strong>, and which vary depending on whether you are an <strong>individual or a company<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-eres-un-particular\"><span class=\"ez-toc-section\" id=\"You_are_a_private_individual\"><\/span>You are a private individual<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p><strong>If you are a private individual<\/strong> <strong>flying unlicensed drones withouth aeronautical knowledge<\/strong>, fines can range from \u20ac60 to \u20ac225,000, depending on:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>If you commit a <strong>minor offence<\/strong>, fines can range from <strong>\u20ac60 to \u20ac45,000<\/strong>.<\/li>\n\n\n\n<li>When you commit a <strong>serious offence<\/strong>, the fine ranges from <strong>\u20ac45,001 to \u20ac90,000<\/strong>.<\/li>\n\n\n\n<li>But if you commit a <strong>very serious offence<\/strong>, fines can range from <strong>\u20ac90,001 to \u20ac225,000<\/strong>.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-eres-una-empresa\"><span class=\"ez-toc-section\" id=\"You_are_a_company\"><\/span>You are a company<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>And if you are a <strong>company, regardless of whether you have knowledge or not<\/strong>, the infringements are significantly higher:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>For minor offences, fines range from \u20ac4,500 to \u20ac70,000.<\/li>\n\n\n\n<li>For serious misconduct, the fine will range from \u20ac70,001 to \u20ac250,000.<\/li>\n\n\n\n<li>And if you commit a very serious offence, the fine you can receive will be between 250,001 and 4.5 million euros.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>For this reason it is <strong>important that you know what you are doing<\/strong> at all times, whether you have a license to fly a drone or not, or you fly a drone over 250gr or not.
