category of civil drones"},"content":{"rendered":"\n<p>The <strong>&#8216;open&#8217; category of civil drones<\/strong> is the category of <strong>low risk<\/strong> flight for which <strong>no operational authorisation or pre-flight declaration is required<\/strong>.<\/p>\n\n<p>This is the <strong>main and differential characteristic<\/strong> of this category, because if you had to ask for any kind of <strong>authorisation or declaration<\/strong> you would no longer be performing your activity in the &#8216;open category&#8217; but in the &#8216;specific category&#8217; or in the &#8216;certified category&#8217;.<\/p>\n\n<p>Even if you are not subject to having to <strong>register as a drone operator<\/strong> and you can fly a <a href=\"https:\/\/javiergomiz.com\/en\/unlicensed-drones\/\">drone without a licence<\/a> with complete freedom, I recommend you read my article on what are the <a href=\"https:\/\/javiergomiz.com\/en\/flying-drone-spain\/\">5 minimum requirements to fly a drone in Spain<\/a>.<\/p>\n\n<p>It is essential that you are <strong> fully aware of these requirements<\/strong> so that you do not receive a <strong>fine for flying a drone<\/strong> in Spain under irregular conditions, and above all to avoid damage to structures or worse, 14<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>You are <a href=\"https:\/\/javiergomiz.com\/en\/uav-insurance-espana\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">required to have drone liability insurance<\/a> to fly your drone just if you meet a number of requirements, except for those declared as toys. The prices of these insurances <strong>vary depending on the insurer and whether your activity will be<\/strong> recreational or professional. <s>This will be maintained until the <strong> next Royal Decree<\/strong> comes out, in which it is expected that <strong>drones weighing less than 250 grams will not have to have insurance<\/strong>, and the distinction between types of drone insurance (recreational and professional) will disappear and there will be only one type<\/s>. This registration, if it has to be done at all, <strong>should be done only once<\/strong> and in the Member State of usual residence. However, with the <strong>change in regulations<\/strong>, anyone coming from abroad will have to register with the Ministry of the Interior, even if they have already done so in their EU country of origin.<\/li>\n\n\n\n<li>Currently <strong>you are not obliged to put a fireproof identification plate<\/strong>, but you are obliged to <strong>put your drone operator number<\/strong> on all your drones, and if you add any other personal data if you lose it, you will be able to recover it.<\/li>\n\n\n\n<li>In case you operate with observers to assist you in your piloting, you should have procedures in place to coordinate the activities between them and establish a list of personnel and tasks assigned to them.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-requisitos-generales-para-pilotar-un-dron-en-categoria-abierta\"><span class=\"ez-toc-section\" id=\"Requirements_for_the_open_category_for_drones\"><\/span>Requirements for the open category for drones<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>Please note that <strong>drone flights in the &#8216;open&#8217; category<\/strong> must comply with the <strong>requirements<\/strong> of Implementing Regulation (EU) 2019\/947, which are set out in Art. 4:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Your drone weighs <strong>less than 25 kg<\/strong>.<\/li>\n\n\n\n<li>Fly at a &#8220;safe&#8221; distance from people and <strong>do not fly over concentrations<\/strong> of them: demonstrations, concerts, sporting events etc&#8230; The latter is defined in article 2.3:\n<ul class=\"wp-block-list\">\n<li>It is defined by <strong>concentrations of people<\/strong> when the density of these does not allow a safe dissolution of them to avoid the impact of the drone in case of fall.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The drone to be operated belongs to one of the <strong>classes already established<\/strong> in Delegated Regulation (EU) 2019\/45, is <strong>privately built<\/strong> or meets the <strong>conditions established<\/strong> for drones without class marking. <\/li>\n\n\n\n<li><strong>MTOM<\/strong> (<em>masa m\u00e1xima al despegue<\/em>) <strong>inferior a 25 kg<\/strong><\/li>\n\n\n\n<li>Maintain a <strong>horizontal safe distance<\/strong> from outsiders <strong>without overflying<\/strong> concentrations of people.<\/li>\n\n\n\n<li>Always keep the drone at a distance that <strong>can be seen (VLOS)<\/strong>, unless we are using the <strong>&#8220;follow me&#8221; mode<\/strong>, or when <strong>we have observers<\/strong> (article 2.24) that can visually follow the unmanned aircraft.<\/li>\n\n\n\n<li>Maximum flight height of <strong>120 meters<\/strong> from the closest point to the surface, always following the terrain orography.<\/li>\n\n\n\n<li>The UAS shall not <strong>drop any object<\/strong> and shall not <strong>carry dangerous goods<\/strong>.<\/li>\n\n\n\n<li>Interrupt the flight in case of danger with other aircraft, people, animals or anything else.<\/li>\n\n\n\n<li>Read the manual and follow the manufacturer&#8217;s instructions<\/li>\n\n\n\n<li>NEVER drive under the influence of drugs or alcohol, the consequences can be disastrous in every way.<\/li>\n\n\n\n<li>Do not fly if any relief or emergency work was being carried out in the area.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-edad-minima-de-los-pilotos-a-distancia\"><span class=\"ez-toc-section\" id=\"Minimum_age_of_remote_pilots\"><\/span>Minimum age of remote pilots<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>Requirements listed in <strong>Art. 9<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The <strong>minimum age for remote pilots in the open drone category<\/strong> is <strong>12-14 years old<\/strong>.<\/li>\n\n\n\n<li><strong>There is no minimum age requirement<\/strong> for pilots:\n<ul class=\"wp-block-list\">\n<li>They operate in <strong>subcategory A1<\/strong> with a class 0 <a href=\"https:\/\/javiergomiz.com\/en\/type-of-drones\/\">drone type<\/a> (explained below) and their manufacturer lists it as a <strong>toy <\/strong> (drones that are designed for persons under 14 years of age), i.e. UAS that do not require registration as a drone operator.<\/li>\n\n\n\n<li>Private construction drones with a MTOM of less than 250gr (these drones may not have an image capture system).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Member States may lower the minimum age depending on the risks and related operations in their territory:\n<ul class=\"wp-block-list\">\n<li>In 4 years in open category<\/li>\n\n\n\n<li>Up to 2 years if piloting in a specific category<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>This reduction is only applicable to the UAS of that Member State.<\/li>\n\n\n\n<li>Member States may also specify a different minimum age for remote pilots in the framework of <strong>clubs and associations<\/strong>.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-block-heading\" id=\"h-drones-sin-marcado-de-clase-legacy-que-no-sean-de-constuccion-privada\"><span class=\"ez-toc-section\" id=\"Drones_without_class_marking_%E2%80%98legacy_other_than_privately_built_drones\"><\/span>Drones without class marking (\u2018legacy\u2019) other than privately built drones<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p><strong>Provisions on the use of drones<\/strong> in the open category are laid down in Art. 20 of Implementing Regulation (EU) 2019\/947. <\/p>\n\n<p><em>Legacy <\/em> drones are drones that have been introduced on the market <strong>before 1 January 2024<\/strong>, that do not belong to C0, C1, C2, C3 or C4 and that cannot be fitted with the <a href=\"https:\/\/javiergomiz.com\/en\/drone-remote-identification\/\">drone remote identifier<\/a>, which is mandatory for all drones since 1 January that want to fly <strong>outside the open category<\/strong>.<\/p>\n\n<p><em>Legacy<\/em> drones may be used if:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The MTOM of the UAS + payload + is strong, <strong>&lt;250 grams<\/strong>, in <strong>subcategory A1<\/strong>.<\/li>\n\n\n\n<li>The MTOM of the UAS + fuel + payload + is strong, <strong>&lt;25kg<\/strong>, in <strong>subcategory A3<\/strong>.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-drones-legacy-c0-y-de-construccion-privada\"><span class=\"ez-toc-section\" id=\"Legacy_C0_and_privately_built_drones\"><\/span>Legacy, C0 and privately built drones:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>NON-PARTICIPANTS<\/strong> (people who are NOT aware of the instructions and safety precautions of the operation) may fly over, but not concentrations of people.<\/li>\n\n\n\n<li>Familiar with the drone <strong>manufacturer&#8217;s instructions<\/strong>.<\/li>\n\n\n\n<li>With <strong>UAS under 250 gr<\/strong> you do not have to register with AESA as an operator, only if your drone:\n<ul class=\"wp-block-list\">\n<li>It has a MTOM (maximum take-off mass) <strong>greater than 250 grams<\/strong>.<\/li>\n\n\n\n<li>Can transfer more than <strong>80J of energy<\/strong> on impact.<\/li>\n\n\n\n<li>It is equipped with a sensor to capture personal data (<a href=\"https:\/\/javiergomiz.com\/en\/photo-video-drone-services\/drone-photography\/\">photography<\/a>, <a href=\"https:\/\/javiergomiz.com\/en\/photo-video-drone-services\/video-aerial-dron\/\">video<\/a> or sound), unless the drone manufacturer states in the instructions that the <strong>drone is a toy<\/strong> (in accordance with Directive 2009\/48\/EC).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>In this category would be for example the <a href=\"https:\/\/amzn.to\/4h4ova2\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">MINI 2<\/a> and <a href=\"https:\/\/amzn.to\/408fjLe\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">MINI 3 PRO<\/a>.<\/p>\n\n<div A3<\/h2>\n\n<p>The <strong>&#8216;open&#8217; category of civil drones<\/strong> is divided into <strong>3 subcategories<\/strong>: <strong>A1, A2, and A3<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading enlaces-ancla\" id=\"clase0\">Subcategory A1 of the &#8216;open&#8217; category (drones weighing less than 250 gr)<\/h3>\n\n<p>In this flight, <strong>avoidance<\/strong> is performed:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Flying over persons not involved<\/strong> in the flight operation, i.e. it is not allowed to <strong>fly over persons not involved<\/strong> in the operation.<\/li>\n\n\n\n<li>It is not allowed to fly over <strong>groups or concentrations<\/strong> of people.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p><strong>Drones wishing to operate<\/strong> in this subcategory must <strong>comply with the following<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>It is not mandatory to obtain a drone license<\/strong> through the exam but <strong>highly recommended<\/strong>.<\/li>\n\n\n\n<li>Be <strong>privately built<\/strong> drones with a <strong>MTOM strong, &lt;open250 grams<\/strong>, and with a <strong>maximum speed strong, &lt;19 m\/s<\/strong>. The <a href=\"https:\/\/javiergomiz.com\/en\/dji-mini-3-pro\/\">DJI Mini 3<\/a> with a maximum speed of 13 m\/s is an example.<br\/>Another more economical example could be the <a href=\"https:\/\/javiergomiz.com\/en\/holy-stone-hs440\/\">Holy Stone HS440<\/a>.<\/li>\n\n\n\n<li>Drones <strong>without class marking<\/strong> and having entered the market <strong>before 1 January 2024<\/strong> with the requirements for \u2018drones without class marking\u2019.<\/li>\n\n\n\n<li>With <strong>Class 0 marking label<\/strong>:\n<ul class=\"wp-block-list\">\n<li>&lt; 250 g<\/li>\n\n\n\n<li>&lt; 19 m\/s<\/li>\n\n\n\n<li>Power supply<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>With <strong>Class 1 marking<\/strong> label:\n<ul class=\"wp-block-list\">\n<li>A drone licence needs to be obtained through a test that can be taken free of charge on the AESA website.<\/li>\n\n\n\n<li><strong>You may not fly over groups of people or NON-PARTICIPANTS<\/strong>, and limit the flight time over people who have unexpectedly gotten inside the boundaries where we are operating.<\/li>\n\n\n\n<li>MTOM &lt;900 g or transmitted impact energy &lt; 80 J<\/li>\n\n\n\n<li>Maximum horizontal flight speed of 19 m\/s<\/li>\n\n\n\n<li><strong>Power supply<\/strong><\/li>\n\n\n\n<li><strong>Unique serial number<\/strong><\/li>\n\n\n\n<li>Direct and network remote identification system<\/li>\n\n\n\n<li><strong>Geo-awareness<\/strong> system<\/li>\n\n\n\n<li><strong>Low battery warning<\/strong> system for drone and control station<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p><strong>Drones weighing less than 250 grams<\/strong> have less flight restrictions than the rest, but you should know that <strong>you cannot fly freely<\/strong> wherever you want, you may be <strong>subject to flight restrictions<\/strong> in certain areas.<\/p>\n\n<p>Consult the <a href=\"https:\/\/javiergomiz.com\/en\/how-to-use-enaire-drones-map\/\">Enaire drones map<\/a> to know the status of the area where you want to operate and <strong>request the corresponding permits<\/strong> if required. And especially now with the change of regulations (RD 517\/2024) which no longer allows flying in population centres without <a href=\"https:\/\/sede.interior.gob.es\/portal\/sede\/tramites?idAgrupacion=17\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">prior notification to the Ministry of the Interior<\/a>.<\/p>\n\n<p>As examples of drones for this class 1 you would have the <a href=\"https:\/\/javiergomiz.com\/en\/dji-air-3\/\">DJI AIR 3<\/a> and the <a href=\"https:\/\/javiergomiz.com\/en\/dji-mavic-3-classic-2\/\">MAVIC 3<\/a> with a weight of 899gr, at the limit of the A2 subcategory which is 900gr.<\/p>\n\n<h3 class=\"wp-block-heading\">Subcategory A2 of the category &#8216;open&#8217;.<\/h3>\n\n<p>In this subcategory:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>You may not fly above <strong>any non-participant<\/strong>.<\/li>\n\n\n\n<li>You must maintain a <strong>horizontal distance of at least 30 m<\/strong> from persons not involved in the operation or flight, but you may fly <strong>at a distance of 5 m<\/strong> if a <em>low speed mode<\/em> (3 m\/s) is available.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>In this subcategory, <strong>only drones bearing a Class 2<\/strong> marking label, i.e. complying with the following, <strong>may fly<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>MTOM &lt; 4 Kg<\/li>\n\n\n\n<li><strong>Power supply<\/strong><\/li>\n\n\n\n<li>Unique serial number<\/li>\n\n\n\n<li>Direct and network <strong>remote identification<\/strong> system<\/li>\n\n\n\n<li><strong>Geo-awareness<\/strong> system<\/li>\n\n\n\n<li><strong>Low battery warning<\/strong> system for drone and control station<\/li>\n\n\n\n<li>It must be equipped with a <strong>protected data link<\/strong> to prevent misappropriation of the equipment by persons not involved in the operation.<\/li>\n\n\n\n<li>It must be equipped with <strong>lights to control<\/strong> the attitude of the drone and night flight.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Subcategory A3 of the category &#8216;open&#8217;.<\/h3>\n\n<p>In the next subcategory of the <strong>&#8216;open&#8217; drone category<\/strong>, A3, the operations to be carried out must be in:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Areas where outsiders are safe.<\/li>\n\n\n\n<li>A minimum horizontal <strong>safety distance of 150 metres<\/strong> from residential, commercial, industrial or recreational areas.<\/li>\n<\/ul>\n\n<p>UAS or <strong>drones eligible to fly<\/strong> in this subcategory must comply with the following:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Private construction<\/strong> with a MTOM &lt;25 kg<\/li>\n\n\n\n<li><strong>Not class-marked<\/strong> and placed on the market <strong>before 1 January 2024<\/strong>, with the requirements for UAS without class marking<\/li>\n\n\n\n<li>Carry <strong>class C2 marking label<\/strong><\/li>\n\n\n\n<li><strong>Class C3 marking label<\/strong> and complying with the following:\n<ul class=\"wp-block-list\">\n<li>MTOM &lt;25 kg with dimensions less than 3 m<\/li>\n\n\n\n<li>Power supply<\/li>\n\n\n\n<li>Unique serial number<\/li>\n\n\n\n<li>Direct and network remote identification system<\/li>\n\n\n\n<li><strong>Geo-awareness<\/strong> system<\/li>\n\n\n\n<li><strong>Low battery warning<\/strong> system for drone and control station<\/li>\n\n\n\n<li>Equipped with <strong>protection against misappropriation<\/strong> by someone outside the operation<\/li>\n\n\n\n<li><strong>Attitude control<\/strong> and night flight lights<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Bear <strong>class C4 marking label<\/strong> and comply with the following:\n<ul class=\"wp-block-list\">\n<li>MTOM &lt;25 kg<\/li>\n\n\n\n<li><strong>Controllable and safely manoeuvrable<\/strong> by a pilot at a distance according to manufacturer&#8217;s instructions<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>No automatic control modes<\/strong> except to assist the flight without any direct effect on the trajectory and for assistance in case we lose the signal between the remote control and the UAS (<strong>RTH &#8211; <em>Return to home<\/em><\/strong>).<\/li>\n\n\n\n<li>For the purpose of practising <strong>aeromodelling<\/strong><\/li>\n<\/ul>\n\n<p><\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Night_flight_in_open_drone_category\"><\/span>Night flight in open drone category<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>Can a <strong>drone be flown at night<\/strong>? The answer is yes.
