Finally, on June 4, 2024, the new legal framework regulating the use of unmanned aircraft (UAS) was <strong>approved by the Council of Ministers<\/strong>.<\/p>\n\n<p>It is controversial as it brings <strong>more restrictive than permissive changes<\/strong>, and some of them, according to many pilots, are too invasive and do not come to boost the drone sector at a professional level as promised and expected by many.<\/p>\n\n<p>Read on as I will tell you <strong>what the most important changes are<\/strong>, I will also dedicate a longer part to comment on <strong>this controversial part<\/strong> that almost all pilots are complaining about.<\/p>\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"800\" height=\"533\" Additional obligations of the establishment<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n\n\n<h2 class=\"wp-block-heading\" id=\"h-objetivos-de-este-rd\"><span class=\"ez-toc-section\" id=\"Objectives_of_this_RD\"><\/span>Objectives of this RD<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>The RD of drones of June 4 is made to <strong>complete the European legal regime <\/strong> for unmanned aircraft, UAS or drones. <\/li>\n\n\n\n<li>It seeks <strong>to favor the sector<\/strong> by developing and completing the European regulations.<\/li>\n\n\n\n<li>To have a <strong>national regulatory framework<\/strong> consistent <strong>with that of the European Union<\/strong> that provides <strong>stability and legal certainty<\/strong> to the sector for its development, while at the same time safeguarding public safety.<\/li>\n\n\n\n<li>In addition, <strong> it aims to help boost the provision<\/strong> of services and, in general, the <strong>economic activity<\/strong> of the sector, favoring the <strong>competitiveness of Spanish operators and manufacturers<\/strong>.<\/li>\n<\/ul>\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"has-text-align-center\"><a href=\"https:\/\/drive.google.com\/file\/d\/1Ms5pgdQxTfbXd99fvCxQSmWwhZsUeUwW\/view?usp=sharing\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Download here the new UAS Royal Decree<\/a><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-drones-afectados-por-este-rd-uas-517-2024\"><span class=\"ez-toc-section\" id=\"Drones_concerned_by_this_RD_UAS_5172024\"><\/span>Drones concerned by this RD UAS 517\/2024<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The scope of application of this new Royal Decree will apply to Spanish territory and airspace a:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Civilian drones<\/strong> and UAS (civilian unmanned aircraft), their <strong>personnel and organisations<\/strong> involved in their activities.<\/li>\n\n\n\n<li>ATS (air traffic service providers), aerodrome or heliport managers, whether civil or military.<\/li>\n\n\n\n<li>AIS (aeronautical information service providers), U-SPACE service providers and the single common information service provider.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-drones-exentos-del-real-decreto-uas\"><span class=\"ez-toc-section\" id=\"Drones_exempted_from_the_Royal_Decree_UAS\"><\/span>Drones exempted from the Royal Decree UAS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>There are some <strong> cases where this Royal Decree does NOT apply<\/strong> that are important to know because as a pilot they will give you a wider margin of maneuver.<\/p>\n\n<p>It is important to know what our limits are when it comes to riding, but also to know when these limits do not apply to us:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The use of UAS performed in their entirety in <strong>enclosed indoor<\/strong> spaces in those spaces where there is a <strong>very low probability of the unmanned aircraft escaping<\/strong> into open airspace (\u201cindoor operations\u201d);<\/li>\n\n\n\n<li><strong>Unmanned tethered aircraft<\/strong> referred to in Annex I, paragraph 2(2), points a) and b), of the Basic Regulation<\/li>\n\n\n\n<li>Unmanned aircraft and <strong>military UAS<\/strong> or UAS used in military activities or services, as well as personnel and organizations involved in them.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-puntos-importantes-de-este-real-decreto-uas-de-4-de-junio\"><span class=\"ez-toc-section\" id=\"Important_points_of_this_Royal_Decree_UAS_of_June_4\"><\/span>Important points of this Royal Decree UAS of June 4<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-nueva-zonificacion\"><span class=\"ez-toc-section\" id=\"New_zoning\"><\/span>New zoning<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>It finalises the <strong>distinction between recreational and professional<\/strong> activities and <a href=\"https:\/\/www.seguridadaerea.gob.es\/sites\/default\/files\/UAS-OPS-DT01_Ed.01_Zonas.geograficas.UAS.del.RDUAS.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">their specific zoning requirements<\/a>, as the European regulation does not distinguish between <strong>professional and recreational<\/strong>, but between <a href=\"https:\/\/javiergomiz.com\/en\/type-of-drones\/\">types of aircraft<\/a> according to different degrees of safety <strong>based on weight<\/strong>. These areas appear on the <a href=\"https:\/\/javiergomiz.com\/en\/how-to-use-enaire-drones-map\/\">Enaire Drones map, learn how to use it in this article<\/a>.<\/li>\n\n\n\n<li><strong>It shall be possible to fly within visual range (VLOS) up to an altitude of 60 metres without requiring clearance or coordination<\/strong>, but outside the environment of aerodromes or heliports, civil or military, aerodrome flight information zones <strong>(FIZs)<\/strong> and aerodrome transit <strong>zones <\/strong> <strong>(ATZs)<\/strong>.<\/li>\n\n\n\n<li><strong>General zones<\/strong> and a framework for the <strong>creation of particular zones<\/strong> are established. <em> (Chap. V, sect. 3\u00ba. art. 45)<\/em><\/li>\n\n\n\n<li>For reasons of operational safety, public safety and privacy, a <strong>communication must be made to the Ministry of the Interior<\/strong> in case you fly in <strong>populated environments<\/strong> (open category). The timing of this communication has been reduced from <strong>10 days to 5<\/strong> calendar days with respect to the expected date of commencement of the operation.<br \/><em><em>(cap\u00edtulo V, 2\u00aa section, art. 40 a).)<\/em><\/em><\/li>\n\n\n\n<li>A framework for the <strong>single digital publication<\/strong> of UAS geographic areas is created.<\/li>\n\n\n\n<li>Royal Decree UAS 1919\/2009 on <strong> aerial demonstrations<\/strong> is amended, bringing certain requirements into line with those established in the European regulation, such as distances to uninvolved personnel. In addition, it includes the <strong>obligation of NOTAM management<\/strong> directly by the director of the demonstration with the air traffic service provider (ATSP) concerned, without AESA acting as an intermediary. category<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Flying over buildings<\/strong><\/li>\n\n\n\n<li><strong>Stable constructions<\/strong> similar to buildings, houses.<\/li>\n\n\n\n<li><strong>Domicile of natural persons<\/strong>, including in all cases their recreational areas, courtyards and similar areas, whether publicly or privately owned. similar areas, whether publicly or privately owned.<\/li>\n<\/ul>\n<\/blockquote>\n\n<p><\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-u-space\"><span class=\"ez-toc-section\" id=\"U-SPACE\"><\/span>U-SPACE<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The <strong>U-SPACE legal regime has been completed<\/strong>, especially in terms of competencies and by establishing limitations and operational conditions associated with UAS geographic areas.<\/li>\n\n\n\n<li>The Interministerial Commission for Defense and Transport (CIDETRA) is responsible for the designation of airspace as U-Space.<\/li>\n\n\n\n<li>AESA will manage Common Information Service Provider (CISP) certificates and U-Space Service Provider (USSP) certificates.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-operaciones-no-easa-civiles\"><span class=\"ez-toc-section\" id=\"Civilian_NON_EASA_operations\"><\/span>Civilian NON EASA operations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>In this Royal Decree UAS have been <strong>practically regulated for NON EASA<\/strong>, customs, police, search and rescue, fire fighting, border control, coastal surveillance or similar operations. <em>(Chapter III, Section 1)<\/em><\/li>\n\n\n\n<li>The <strong> training regime is completed<\/strong> for operations carried out under an operational authorization (specific category), those for activities not subject to European regulations, those NOT subject to EASA, and those reserved for the training of radio operators specific to UAS Drones.<\/li>\n\n\n\n<li>Elimination of operational limitation with UAS up to 25 kg maximum take-off mass (MTOM).<\/li>\n\n\n\n<li>It will be possible to fly in <strong> &#8216;specific&#8217; you will have to record that the drone will no longer be used.<\/p>\n\n<p>The <strong>UAS registration part begins in Chapter VI<\/strong>. I will explain it below.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-articulo-53-creacion-del-registro\"><span class=\"ez-toc-section\" id=\"Article_53_Creation_of_the_Registry\"><\/span>Article 53. Creation of the Registry<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>The Registry of unmanned aircraft of the Ministry of the Interior is created within the Secretariat of State for Security, for the purpose of <strong>preventing, investigating or detecting the commission of criminal<\/strong> and administrative offences, including the protection and <strong>prevention of threats to public safety<\/strong>.<\/p>\n\n<p><strong>Aircraft or maximum take-off mass of 250 grams or more or equipped with a camera, regardless of its MTOM, will be registered, unless it is a toy<\/strong>.<\/p>\n\n<p>The data we would have to record are:<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Name or company name of the manufacturer, model and serial number<\/strong> of the aircraft.<\/li>\n\n\n\n<li><strong>Name, surname and personal identification number or corporate name or relationship and address<\/strong> of the establishment that sells the aircraft or the data that allow the identification of the <strong>commercializing company<\/strong> in the case of online purchases.<\/li>\n\n\n\n<li><strong>Name, surname and personal identification number, company name or corporate name, tax identification number and domicile<\/strong>, natural or legal persons <strong>acquiring <\/strong> the unmanned aircraft.<\/li>\n\n\n\n<li>The registry shall be organized in such a way that aircraft data <strong>are linked<\/strong> to their owners at all times.<\/li>\n<\/ol>\n\n<h3 class=\"wp-block-heading\" id=\"h-articulo-54-obligaciones-de-inscripcion\"><span class=\"ez-toc-section\" id=\"Article_54_Registration_obligations\"><\/span>Article 54. Registration obligations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The <strong>seller is obliged to communicate<\/strong> to the UAS Registry according to the information provided for in Article 52.2, letters a) to c), both inclusive, <strong>within 1 month<\/strong> from the day following the purchase\/sale.<\/li>\n\n\n\n<li>If you buy a drone <strong>outside Spain you are obliged to communicate<\/strong> to the UAS registry the information provided in the article, etc., <strong>within one month<\/strong> from the day after the purchase.<\/li>\n\n\n\n<li>If you have owned drones since before the entry into force of this new Royal Decree and have not registered them, you have 6 months from 25 June to register them.<\/li>\n\n\n\n<li>If you fail to comply with the <strong>obligations <\/strong> set forth in this article, you may be <strong> subject to the penalties<\/strong> set forth in this law.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-articulo-55-obligaciones-de-comunicar-la-transmision\"><span class=\"ez-toc-section\" id=\"Article_55_Obligations_to_communicate_the_transfer\"><\/span>Article 55. Obligations to communicate the transfer<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>If <strong>you are the seller of a UAS<\/strong>, you have a period of one month from the day after selling it and you must make a <strong>declaration <\/strong> stating: the <strong>identification <\/strong> of the aircraft, the seller and the buyer, as well as the date and title of transfer.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Failure to comply<\/strong> with the obligation will result in administrative, civil and criminal liabilities in accordance with the applicable regulations. And may result in the <strong>immobilization or deposit of the aircraft<\/strong>, in accordance with the provisions of the regulations in force.<\/li>\n<\/ul>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Your drone may be taken away from you if you do not communicate!<\/p>\n<\/blockquote>\n\n<h3 class=\"wp-block-heading\" id=\"h-articulo-56-obligaciones-sobre-la-perdida-del-uas\"><span class=\"ez-toc-section\" id=\"Article_56_Obligations_on_loss_of_UAS\"><\/span>Article 56. Obligations on loss of UAS<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>The <strong>owner of the aircraft<\/strong> or object of registration is <strong>obliged to notify the UAS registry of its disappearance, loss or theft, its subsequent location or recovery<\/strong>, as well as its total destruction within a <strong>maximum period of 15 days<\/strong> from the following day.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-articulo-57-obligaciones-adicionales-del-establecimiento\"><span class=\"ez-toc-section\" id=\"Article_57_Additional_obligations_of_the_establishment\"><\/span>Article 57. Additional obligations of the establishment<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p>The <strong>establishment located in Spanish territory<\/strong> that markets the aircraft must keep a record of the UAS they sell.<\/p>\n\n<p>Anyone selling a drone will have to have an <strong>aircraft registry with all the aircraft they have sold and the details of the people who bought them<\/strong>.<\/p>\n\n<p>The <strong>owners of these establishments<\/strong> are <strong>obliged to hand over the data of the buyers<\/strong>, that is, us, to the members of the State Security Forces and Corps dependent on the National Government, and to the Police Corps of the Autonomous Communities when they request it for the <strong>purposes of investigation, detection and prosecution of a crime<\/strong>.<\/p>\n\n<p>These personal data will be <strong>deleted from the registry after 5 years<\/strong>.<\/p>\n\n<p>This issue of unmanned aircraft registration was already proposed to be carried out in the previous Royal Decree UAS of 1036\/2017, and which was finally revoked, perhaps the war situation taking place in a part of Europe has given the green light to these proposals?<\/p>\n\n<p>What do you think of these new changes that have been presented in this new UAS Royal Decree?
